1.Acceptance of Terms
By accessing or using Kneadly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including solo therapists, team members, and business owners.
2.Description of Service
Kneadly is a business management platform designed for massage therapists and wellness professionals. The Service includes appointment scheduling, client management, payment processing, automated communications, SOAP notes, intake forms, and related features. Kneadly reserves the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3.Accounts and Registration
To use Kneadly, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials and not share them with others.
- Notify us immediately at support@wellsyncapp.com if you become aware of any unauthorised access to your account.
- Accept responsibility for all activity that occurs under your account.
You must be at least 18 years of age to create an account and use the Service.
4.Plans and Payments
Kneadly offers Free, Pro, and Team subscription plans. By selecting a paid plan, you agree to the following:
- Subscription fees are billed in advance on a monthly or annual basis, as selected at the time of purchase.
- All payments are processed securely through Stripe. Kneadly does not store your full payment card details.
- You authorise Kneadly to charge your payment method for the applicable subscription fee on each renewal date.
- Subscriptions automatically renew unless cancelled before the renewal date.
- Refunds are handled on a case-by-case basis. Contact us at support@wellsyncapp.com within 7 days of a charge if you believe an error has occurred.
5.Acceptable Use
You agree not to use Kneadly to:
- Violate any applicable law or regulation.
- Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Send unsolicited commercial messages (spam) to clients or third parties via the platform's communication tools.
- Attempt to gain unauthorised access to any part of the Service or its underlying systems.
- Resell, sublicense, or otherwise make the Service available to third parties without our written permission.
- Use the Service in any way that could disable, damage, overburden, or impair its infrastructure.
6.Client Data and Privacy
When you use Kneadly to manage client records, you are responsible for ensuring you have the appropriate consent to collect and store that client information. You retain ownership of your client data. Kneadly processes client data on your behalf as a data processor and does so in accordance with our Privacy Policy. You agree not to store sensitive health information beyond what is reasonably required for your practice.
7.Intellectual Property
All content, features, and functionality of Kneadly — including but not limited to software, design, text, graphics, and trademarks — are owned by Kneadly and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your business purposes. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.
8.Disclaimers
Kneadly is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any errors or omissions in content, or for any actions taken in reliance on information provided through the Service.
9.Limitation of Liability
To the fullest extent permitted by law, Kneadly and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. In no event will our total liability to you exceed the amount you paid to Kneadly in the twelve months preceding the event giving rise to the claim.
10.Termination
You may cancel your account at any time through your account settings. Kneadly reserves the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your right to use the Service will immediately cease. We will retain your data for a reasonable period to allow you to export it, after which it may be deleted in accordance with our data retention practices.
11.Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Kneadly operates, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes will be submitted to binding arbitration in accordance with applicable arbitration rules.
12.Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify users via email or an in-app notice where appropriate. Continued use of Kneadly after updated Terms take effect constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
